The Challenge
Between 1997-1998 the City of Everett, Washington entered into a contract with Robison
Construction Inc, (RCI) for the construction of a new finished-water plant.
Subsequent to the completion of the project, RCI filed a request for additional
compensation of $1 million, arguing that the City had impacted them.
The Process
Bluewater requested from the City of Everett copies of the contractual documents issued to RCI at the award
of the contract. Bluewater further declined to review RCI's documentation until they
had prepared an independent construction schedule.
Bluewater then reviewed the submittal log against this schedule
to ascertain whether RCI was impacted by delay in submittal reviews and issuance
of change orders.
The Results
Based on the independent analysis by Bluewater, the City of Everett proposed to pay $300,000 to cover the cost
of approved change-orders and an extension of the contract completion by twenty-one (21) calendar days for
owner-caused delays.
